The NY Times reports on reasonable evidence that supports my long held belief—doctors need the equivalent of “safe harbor practices.” Safe harbor polices are well ingrained in food production, and children’s advertising, and many other forms of commerce. At its essence, steps and procedures are identified ahead of time, and if followed, no liability for the person or corporation that follows.
Doctor’s need safe harbors to avoid a mindset driven by fear and accusation. And this would be one of the best results for medical malpractice reform, leave the definition of awards alone, leave the burden of proof alone, focus on the mindset of the practitioners and give them a safe place to deliver care to their patients.
